Decision on instrument
An Environmental Compliance Approval with Limited Operational Flexibility (Air) was issued which replaces all the current Environmental Compliance Approvals for Air at this facility and includes the addition of new or historically unapproved sources for all emissions from Lush Manufacturing Ltd., located in the City of Toronto, Ontario.
This facility produces handmade ballistics/bath bomb products. The approval includes all sources at the facility, including:
- ballistics manufacturing
- packaging operations
- non-process sources of combustion
Emissions to the air from this facility include:
- nitrogen oxides
- limonene
- 2-propanol
- ethanol
- benzaldehyde
The Environmental Compliance Approval with Limited Operational Flexibility (Air), when issued permits modifications to the facility subject to limits on operational flexibility that include a production limit for the facility to be specified on the Environmental Compliance Approval with Limited Operational Flexibility (Air). The limited operational flexibility conditions have an expiry date. The company will be required to make an application for amendment at that time to renew these conditions.

Effets de la consultation
Comments received were reviewed and where appropriate were considered in the ministry’s decision whether or not to proceed with this proposal. In this case, the comments are consistent with concerns within the ministry and as a result, several terms and conditions were added to the approval. The terms and conditions do not represent all conditions in the approval, but are those related to the comment on the proposal.
Summary of comments
Concerns were raised over the odour emissions from the facility, the operating hours and the impact over the nearby residential community.
Ministry's response to comments
Conditions included in the new ECA for 50 Jutland were carefully drafted to include steps toward effective odour impact reduction on the neighbouring properties. Below are terms and conditions of interest in the ECAs that will be issued to Lush Manufacturing Ltd.:
- prepare a proper Operation and Maintenance plan, which shall include continuous improvement efforts to minimize odour
- develop and implement an Odour Management Plan which includes modifications to the facility's emission sources
- prepare a Technology Benchmarking Report, subsequent to Source Testing, to study additional odour impact reduction options
- prepare an environmental Complaint Response Plan and Record Keeping procedure

Appeal process for decisions published before June 1, 2021
If you’re an Ontario resident, you can start the process to appeal this instrument decision.
First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.
If the appellate body grants leave, the appeal itself will follow.
Seek leave to appeal
To seek leave to appeal, you need to do these three things:
- prepare your application
- provide notice to the minister
- mail your application to three parties
1. Prepare your application
You’ll need to prepare an application. You may wish to include the following things in your application:
- A document that includes:
- your name, phone number, fax number (if any), and/or email address
- the ERO number and ministry reference number (located on this page)
- a statement about whether you are a resident in Ontario
- your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
- the parts of the instrument that you’re challenging
- whether the decision could result in significant harm to the environment
- the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
- the grounds (facts) you’ll be using to appeal
- the outcome you’d like to see
- A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
- Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered
The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:
- is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
- could the decision you wish to appeal result in significant harm to the environment?
2. Provide your notice
You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.
In your notice, please include a brief description of the:
- decision that you wish to appeal
- grounds for granting leave to appeal

3. Mail your application

This proposal is for an Environmental Compliance Approval with Limited Operational Flexibility (Air) which replaces all the current Environmental Compliance Approvals for Air and includes the addition of new or historically unapproved sources for all emissions from Lush Manufacturing Ltd., located at 50 Jutland Road, in the City of Toronto, Ontario. This facility produces handmade scented soap and detergent products.
The application includes all sources at this facility but the assessment of emissions also includes sources at 35 Jutland Road across the street, including manufacturing and packaging of soap and detergent products, and non-process sources of combustion.
Emissions to the air from this facility include:
- odour
- nitrogen oxides
- limonene
- 2-propanol
- ethanol
- benzaldehyde
The Environmental Compliance Approval with Limited Operational Flexibility (Air), when issued permits modifications to the facility subject to limits on operational flexibility that include a production limit for the facility to be specified on the Environmental Compliance Approval with Limited Operational Flexibility (Air).
