The proposal was for a new Environmental Compliance Approval for industrial stormwater management works serving 2605369 Ontario Inc., located at 621 Stewart Boulevard, in the Town of Brockville.

The stormwater management works are comprised of stormwater quality control, quantity control, and erosion control works, which include an on-site stormwater management oil/grit separator that discharges to an existing ditch along the north side of Stewart Boulevard, south of the property.

The attached document is intended for posting on the Environmental Registry in order to provide the reader with the substantive content of the issued instrument. Please note the official version may be differently formatted or otherwise contain minor variations from this version.

Question: What is the name of the organization identified with 2605369 Ontario Inc.?
Question: Is this Brockmoor Development Corporation Ltd. but with the address changed?
Response: 2605369 Ontario Inc. bought the subject property from Brockmoor Development Corporation Ltd.

Question: How is this application different than the one made by Brockmoor Development Corporation on December 1, 2017
Response: There is no difference between this application and the one made by Brockmoor Development Corporation on December 1, 2017. The previous application made by Brockmoor Development Corporation was closed due to the lack of information needed to proceed with the review. The proposed work remained the same.

Question: What additional information have been submitted that was not submitted on December 1, 2017 which led to the cancellation on the December 1, 2017 instrument.
Response: Proof of legal name had not been provided in the initial submission on December 1, 2017, which led to the cancellation of the original submission.

Question: The description of north ad south is confusing and perhaps could be even misleading. Thus, a map showing the north/south and the flow of discharge would be appreciated.
Response: Proposal Notice mentioned the address where the application documents can be viewed.

Question:. What additional information was requested by the MOECC that supposedly now has been submitted? A copy of the requested information and that provided would be appreciated.
Response: Proof of legal name had been missing from the original submission and it was provided in the subsequent submission. Proposal Notice mentioned the address where the application documents can be viewed.

Question:. Why is the discharge going into the ditch and not into the water and sewer lines that have been put in and are specially mentioned when presented and passed by Council on June 13, 2017.
Response: There is no storm sewer on Stewart Blvd. Sanitary wastewater from the site will go into the sanitary sewers and storm water will go into the ditch.

Question: If the discharge does go into the ditch - where else from the ditch will it go? Will it end up in some unnamed watercourse within the St. Lawrence direct Watershed?
Response: Storm water discharge from the site will go to the roadside ditch and eventually go to an unnamed watercourse within the St. Lawrence direct watershed.

Question: How will the discharge effect the landfill?
Response: Non-contact storm water discharge from the site will go to the roadside ditch not to a landfill site.

Question . How will the discharge effect the wells of the surrounding homes?
Response: Non-contact storm water discharge from the site will go to the roadside ditch not to surrounding lands.

Question: How will the discharge effect the habitat of the endangered and species of risk?
Response: Non-contact storm water discharge from the site will not affect the habitat of the endangered and species of risk.

Question: How will the discharge effect flooding with rain and or snow melt and in drought conditions?
Response: Quantity and quality control for the site were provided.

Question: Is there an obligation by the Developer/Owner/City of Brockville to notify the residents of the City of Brockville and surrounding areas of this discharge?
Response: Ministry notified the residents of surrounding area through the EBR posting.

The comment did not have a direct impact on whether or not to issue the approval.

Appeal process for decisions published before June 1, 2021

If you’re an Ontario resident, you can start the process to appeal this instrument decision.

First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.

If the appellate body grants leave, the appeal itself will follow.

Seek leave to appeal

To seek leave to appeal, you need to do these three things:

  1. prepare your application
  2. provide notice to the minister
  3. mail your application to three parties

1. Prepare your application

You’ll need to prepare an application. You may wish to include the following things in your application:

  1. A document that includes:
    • your name, phone number, fax number (if any), and/or email address
    • the ERO number and ministry reference number (located on this page)
    • a statement about whether you are a resident in Ontario
    • your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
    • the parts of the instrument that you’re challenging
    • whether the decision could result in significant harm to the environment
    • the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
    • the grounds (facts) you’ll be using to appeal
    • the outcome you’d like to see
  2. A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry

What is considered

The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:

  1. is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
  2. could the decision you wish to appeal result in significant harm to the environment?

2. Provide your notice

You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.

In your notice, please include a brief description of the:

  • decision that you wish to appeal
  • grounds for granting leave to appeal
