Approval is granted to GFL Environmental Services Inc. (GESI) to establish and operate a Waste Disposal Site (Transfer/Processing) at 3385 Hawthorne Rd, Ottawa, Ontario. The approval allows:

  1. to receive, process and/or transfer Non-Hazardous Solid, Liquid Industrial, Hazardous Waste, non-regulated items for recycle, and decontamination for reuse or disposal.
  2. receive, process and temporary storage of Municipal Hazardous and Special Waste (MHSW).

The approved site operations will include:

  1. a 1,115 m2 (12,000 sq. ft) engineered building to include up to eight (8) double wall above-ground storage tanks with a maximum capacity of 60,000 L each, a wastewater treatment area, and a section for the temporary storage of waste containers (cages, drums, totes, and pails);
  2. a 140 m2 mixing and solidification pads with containment curbs, having a maximum storage capacity of 100 tonnes, within a 320 m2 fabric shelter building comprised of concrete reinforced containment walls, and concrete reinforced slab;
  3. a 720 m2 concrete pad with containment curbs and a catch basin to provide stability and containment for up to eight (8) dry van trailers for the temporary storage of waste containers (cages, drums, totes, and pails), and up to eight (8) roll off containers for the temporary storage of non-hazardous and Hazardous solid industrial waste; and
  4. a 110 m2 concrete pad within a contained area and a catch basin, located indoors within the 2300 m2 existing building, to provide stability to the dewatering bins for the purposes of decanting solid non-hazardous waste materials.

The Site is approved to accept waste 24 hours a day, 365 days a year with a service area of Canada and the United States of America.

Start the process to appeal

If you’re an Ontario resident, you can start the process to appeal this instrument decision.

First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.

If the appellate body grants leave, the appeal itself will follow.

Seek leave to appeal

To seek leave to appeal, you need to do these three things:

  1. prepare your application
  2. provide notice to the minister
  3. mail your application to three parties

1. Prepare your application

You’ll need to prepare an application. You may wish to include the following things in your application:

  1. A document that includes:
    • your name, phone number, fax number (if any), and/or email address
    • the ERO number and ministry reference number (located on this page)
    • a statement about whether you are a resident in Ontario
    • your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
    • the parts of the instrument that you’re challenging
    • whether the decision could result in significant harm to the environment
    • the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
    • the grounds (facts) you’ll be using to appeal
    • the outcome you’d like to see
  2. A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
  3. Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered

The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:

  1. is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
  2. could the decision you wish to appeal result in significant harm to the environment?

2. Provide your notice

You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.

In your notice, please include a brief description of the:

  • decision that you wish to appeal
  • grounds for granting leave to appeal

3. Mail your application

You’ll need to mail your application that you prepared in step #1 to each of these three parties:

GFL Environmental Services Inc. (GESI) is applying for a new Environmental Compliance Approval (ECA) application to establish a Waste Disposal Site (transfer/processing) at 3385 Hawthorne Road, Ottawa, Ontario.

The function of this site is to receive, process and/or transfer Non-Hazardous Solid, Liquid Industrial, Hazardous Waste, non-regulated items for recycle, and decontamination for reuse or disposal. It is also proposed that a Municipal Hazardous and Special Waste (MHSW) depot to be established.

GESI presently leases approximately 7.4 acres of land with three existing buildings, 2300 square metres (25,000 square feet), 560 square metres (6,000 square feet), and 352 square metres (3,400 square feet), which are used for administration and maintenance purposes, located at 3385 Hawthorne Road, Ottawa, Ontario (herein referred to as the “Site”).

The Site footprint will include the following components:

  • a 1,115 square metre (12,000 square feet) engineered building, to include up to eight double wall above-ground storage tanks with a maximum capacity of 60,000 litres each, a wastewater treatment area, and a section for the temporary storage of waste containers (cages, drums, totes, and pails);
  • a 140 square metre mixing and solidification pads with containment curbs, having a maximum storage capacity of 100 tonnes, within a 320 square metre fabric shelter building comprised of concrete reinforced containment walls, and concrete reinforced slab;
  • a 720 square metre concrete pad with containment curbs and a catch basin to provide stability and containment for up to eight dry van trailers used for the temporary storage of waste containers (cages, drums, totes, and pails), and up to eight roll off containers for the temporary storage of non-hazardous and Hazardous solid industrial waste; and
  • a 110 square metres concrete pad within a contained area and a catch basin, located indoors within the 2300 square metre existing building, to provide stability to the dewatering bins for the purposes of decanting solid non-hazardous waste materials.

GESI is requesting the ability to accept waste 24 hours a day, 365 days a year with a service area of Canada and the United States of America. Most activities are expected to take place during business days and business hours.
