Description of instrument
The Niagara Escarpment Commission is seeking input regarding a subset of the urban/site specific amendment applications to the Niagara Escarpment Plan (NEP), submitted during the Coordinated Land Use Planning Review (CPR). These proposed amendments to the NEP have not been considered or consulted on by Government. In 2017 Cabinet deferred these amendment applications. A final decision on these applications will be made by Cabinet around 2019.
The Ministry of Natural Resources and Forestry and the Niagara Escarpment Commission will consider public and stakeholder comments to inform analysis of the applications and formulation of recommendations to Cabinet.

The purpose of this proposal is to advise that the Niagara Escarpment Commission is seeking input from municipalities, stakeholders, and the public on the subset of site specific, urban use, and urban boundary amendment applications to the Niagara Escarpment Plan that were not circulated, and were deferred during the Coordinated Land Use Planning Review.
These site specific applications include proposals to change land use designations as follows:
Urban Amendment 63 – Change the designation on Map 3 of the Niagara Escarpment Plan on a 12.1 hectare portion of the property from Escarpment Protection Area to Urban Area and to maintain the Escarpment Protection Area designation on the balance of the property
Urban Amendment 64 – Change the designation on Map 1 of the Niagara Escarpment Plan from Escarpment Rural Area to Urban Area
Urban Amendment 65 - Change the designation on Map 1 of the Niagara Escarpment Plan from Escarpment Natural and Protection Area to Urban Area
- Map 1 – UA 63: Part of Lots 14 and 15, Concession 1 NS, (Trafalgar): Town of Milton
- Map 2 – UA 64: 345 and 363 Jerseyville Road (Ancaster), City of Hamilton
- Map 3 – UA 65: 294 York Road (Dundas) City of Hamilton
This proposal is related to the Coordinated Provincial Land Use Plan Review which ended in 2017, specifically to the Amended Niagara Escarpment Plan, 2017 which was posted as ER Registry Number 012-7228.
Other public consultation opportunities
The Niagara Escarpment Commission will undertake additional consultation efforts during the period for this posting, including circulation of the proposed amendments to the Town of Milton and the City of Hamilton as well as notices in local newspapers (Milton Champion and Hamilton Spectator).
After conclusion of the Environmental Registry posting period, input from the NEP Public Interest Advisory Committee will be provided to the Niagara Escarpment Commission.
